E. bleibt wohnen – Eigenbedarf abschaffen!

Der Vermieter Thomas Kattwinkel will den Mieter E. nach 23 Jahren aus seiner Wohnung in der Neustadt vertreiben. Kattwinkel hat das Haus vor kurzer Zeit gekauft, in dem Wissen dass E. dort gerne wohnen bleiben möchte. Nun hat Herr Kattwinkel eine Kündigung wegen Eigenbedarfs ausgesprochen und betreibt eine Räumungsklage vor dem Amtsgericht. Mit Hilfe des Gerichtsvollziehers will Herr Kattwinkel E. auf die Straße setzen.
Ob wirklich Eigenbedarf der Grund für die Kündigung ist, darf bezweifelt werden; vor Ausspruch der Eigenbedarfskündigung hat Herr Kattwinkel noch angeboten, den Eigenbedarf bei Verdoppelung der Miete nicht verfolgen zu wollen. Es gehe ihm “ums Geschäft”. Für uns ist es aber unerheblich, ob der Eigenbedarf tatsächlich besteht oder nur vorgeschoben ist. Kein Gesetz kann darüber hinwegtäuschen, dass es Unrecht bleibt, einen unserer Nachbarn aus der Wohnung zu werfen. Dass Herr Kattwinkel dieses Recht in Anspruch nimmt, weil er genug Geld hat seine Wohnung zu kaufen, macht sein Anliegen keineswegs richtiger.
Am 4. Februar wird beim Amtsgericht über die Rechtmäßigkeit der Kündigung verhandelt. Dabei werden wir E. nicht alleine lassen, denn Eigenbedarfskündigungen gehen uns alle an. Wir rufen alle Mieter_innen der Stadt dazu auf sich unserer Protestkundgebung anzuschließen. Egal wie der Prozess ausgeht, wir lassen nicht zu, dass E. auf der Straße landet.

We call on all tenants of the city to join our protest rally. No matter how the process ends, we will not let E. end up on the street.

Ahora, el Sr. Kattwinkel ha notificado el cese por necesidad personal y está llevando a cabo una acción de desahucio ante el tribunal local. Con la ayuda del alguacil, el Sr. Kattwinkel quiere poner a E. en la calle.
Es dudoso que el motivo de la notificación sea realmente la necesidad personal; antes de emitir la notificación, el Sr. Kattwinkel ofreció no perseguir la necesidad personal si el alquiler se duplicaba. Era un „negocio“ para él. Para nosotros, sin embargo, es irrelevante si la necesidad de los/as propietarios/as existe realmente o es sólo fingida. E. continue d’habiter – Supprimer l’occupation personnelle ! Le bailleur Thomas Kattwinkel veut expulser le locataire E. de son appartement de la Neustadt après 23 ans. Kattwinkel a acheté la maison il y a peu de temps, sachant que E. souhaitait y rester. Monsieur Kattwinkel a maintenant donné un congé pour cause de besoin personnel et poursuit une action en expulsion devant le tribunal d’instance. Avec l’aide d’un huissier de justice, Monsieur Kattwinkel veut mettre E. à la rue.
On peut douter que le besoin personnel soit vraiment le motif de la résiliation ; avant de prononcer la résiliation pour besoin personnel, Monsieur Kattwinkel a encore proposé de ne pas vouloir poursuivre le besoin personnel en cas de doublement du loyer. Il s’agit pour lui de „faire des affaires“. Pour nous, il importe peu de savoir si le besoin personnel existe réellement ou s’il n’est qu’un prétexte. Aucune loi ne peut faire oublier que l’expulsion de l’un de nos voisins reste une injustice. Le fait que M. Kattwinkel fasse valoir ce droit parce qu’il a suffisamment d’argent pour acheter son appartement ne rend en aucun cas sa demande plus juste.
Le 4 février, le tribunal d’instance examinera la légalité de la résiliation. Nous ne laisserons pas E. seul, car les résiliations pour cause d’occupation personnelle nous concernent tous. Nous appelons tous les locataires de la ville à se joindre à notre manifestation de protestation. Quelle que soit l’issue du procès, nous ne laisserons pas E. se retrouver à la rue.
